MissCurvy.com is proud to present a unique, global beauty contest designed to celebrate the “Beauty of Finest Curves.” and organizing online global beauty pageant during the year through each country by creating a global organization called Miss Curvy Global Organization GmbH.

Miss Curvy Global Organization GmbH (here after “MCgo”) reserves the right, at its sole discretion, to change, modify or otherwise alter these rules and regulations at any time. Changes and/or modifications shall become effective immediately upon the posting thereof. Please review these rules and regulations before you apply your online application. All contestants who participate in this online beauty pageant hereby expressly agree to by bound by the following rules and regulations.

1. ONLINE ENTRY.

Go to www.MISSCURVY.com, submit a completed online entry form by creating an account that is linked to “Beauty of Finest Curves.” upload a current (i.e., no older than one month) full-body color photo (upto 6 pics) in JPG, GIF, or PNG format & 1 Video (The file size must be 25MB or smaller).

Submitting application form is FREE (MISSCURVY.com doesn’t charge anyone to submit an application). All photographs, Video or Video links submitted must be the original creation of the entrant and the entrant must own all rights, title and interest in all aspects of the photograph(s) , Video or Video links. By submitting a photograph, Video or Video links the entrant represents and warrants that the photograph, Video or Video links submitted is:

1. the entrant’s original creation;
2. has not been copied in whole or in part from any other work;
3. does not violate or infringe any copyright, trademark, privacy, publicity or other proprietary right of any person or entity; and
4. is the entrant’s sole and exclusive property (if the photograph was taken by some other person, the entrant warrants and represents that the entrant has obtained all rights and permission from the person who took the photograph, Video or Video links so that the entrant owns all rights, title and interest in all aspects of the photograph, Video or Video links).

By submitting a photograph, Video or Video links the entrant further represents and warrants that the entrant has all necessary rights to grant the MISSCURVY.com and its Sponsors all publication and use rights in and to the photograph, Video or Video links and also grants permission to post the photograph(s), Video or Video links on the Internet for public viewing and for possible use in promotional materials including print, online, and/or e-newsletters.

By submitting a photograph, Video or Video links that includes another person or persons the entrant acknowledges and confirms the entrant has their permission and consent. As determined by the MISSCURVY.com in their sole discretion, photographs that include material unfit for publication, objectionable material, material that defames or invades the publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any third party’s personal or proprietary rights will be disqualified. Photographs , Video or Video links that are otherwise in violation of these Official Rules, as determined by the MISSCURVY.com at their sole discretion, will not be accepted.

2. CONTESTANT REQUIREMENTS

1. Contestants should be 18-32 years of age at the time of “Applying for Contest (for invited countries only)” and should be "naturally born" female. They must be 172cm in height or above and resident of the country to the contest they are applying for.
2. There are NO size restrictions. MISSCURVY.com believes ‘Curvy is in all shape and size’ and encourages all females to apply to contest who are proud of their curves.
3. Applicant measurements are very important in consideration of application process and suggested to get somebody to help you take your measurements as accurately as possible.
4. Models already signed to an agency are also eligible to apply for the contest providing they are no more obliged with the agency if they are selected for the “Live-Selection” process.
5. Contestants agree that the contest selection process and its online panel judges’ decisions on all matters relating to the MCgo Beauty Pageant are final, absolute, and binding.
6. Contestants consent and agree to unrestricted use by the MCgo Beauty Pageant and its authorized representatives, advertisers, successor, sponsors, customers, and assigns of the name, pictures, video, video links, likeness, voice, photographs, biographical information and statements for purposes of advertising, promotion and publicity in any and all media throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law. Contestants also waive the right to inspect or approve such pictures, postings, advertising, videos used in connection thereof.
7. MCgo will have the exclusive right to arrange appearances and performances on radio, television, cable, internet, or other broadcast media by the Contestants for promoting the event.
8. Contestants grant MCgo Beauty Pageant and its Agents the right to record any performance or public appearance by Contestants and reproduce, broadcast, or publish these events without compensation, unless prohibited by law. Contestants also waive the right to inspect or approve such pictures, advertising, videos used in connection thereof.
9. Contestants understand and hereby agree that in the event she is selected on Top 10 finalist should be willing, and able, to sign a representational contract with MCgo. Additionally after the announcement of the winner, 1st Runner-Up, or 2nd Runner- Up, she will be required to sign a one-year contract with the MCgo or with its National Representational partner and she shall make herself available for all personal appearances at all scheduled events throughout her reign.
10. All Selected Top 10 finalists agree to participate in all the Photo-shoots & filming of the Miss Curvy National Contest Journey, from the beginning of the contest through to the end without compensation. Additionally, the winners of the Miss Curvy National Contest agree to be photo-shoot & filmed as pageant winners as representative of MISSCURVY.com and the Miss Curvy Global Organization - Beauty Pageant without compensation. She further understands that the inability to fulfill her contract may result in the forfeiture of her title and all prizes must be returned and her successor will take her place for the remainder of the year. Furthermore, she shall be liable for any loss/damage suffered by the MCgo.

3. JUDGING. There will be five (5) rounds of judging: (Review How it works under about us)

3. Verification Process
4. Live Selection (Top 10 Judgment)
5. Global Online Voting
   1. Application Selection.

      At least (50) semi-finalists (each a “Semi-finalist”) will be shortlisted from among all eligible entries based equally on (i) appearance, (ii) personality, (iii) photogenic quality and (iv) vitality, as depicted by the photos & Videos in the Entry application form by MCgo National represented partnering agency which is also authorised to represent the winning contestant in its respective country. Such partnering agency shall be at liberty to devise and employ any criterion for short-listing the contestant for the next round, “Global Ratings”. The processes and decisions of the partnering agency in this regard shall be final and not called into question by anyone. (Partnering agencies can be, Model Agency, Fashion Experts or any Organizations). The shortlisted National Contestants (semi-finalists) will be notified by e-mail about their qualification for the next round within 4 days after the deadline of the Application end date. Semi-finalists will be required to travel to the Finals “Live-selection” process and depart on dates specified by the MCgo. Failure to attend the Finals “Live-selection” process and/or travel on specified dates will result in disqualification from the contest.

   2. Global Ratings:

      The shortlisted (50) semi-finalists shall be rated by a number of global online panel judges, including without limitation, of MCgo National partnering agencies from other countries, Miss Curvy Associates, and people of industry experts specially requested by the MCgo to give their online ratings. The ratings starts from 1 to 12.These ratings are used in as a cumulative figure in final round and shall be one of the factors in determining the Top 10 finalists of the Contest, who will ultimately compete in next round of Global Online audience Voting’s to select the winner of the Miss Curvy National Contest.

   3. Verification Process.

      In the next round, the shortlisted (50) semi-finalists shall be verified through a verification process by MCgo staff to ensure the information on their respective online application forms is true and accurate. The (50) semi-finalists failing this verification process shall be disqualified from the Contest.

   4. Live Selection (Top 10).

      During the Final selection of Top 10 finalists, a live judging (“Live Judging”) will occur (exact date(s) and location(s) will be determined and send information to Top 50 semi-finalists by the MCgo). Top 10 finalists will be judged by a panel of qualified judges invited by MCgo through a discreet Live-Ratings (1 to 12 points) & questions, based on the following criteria: (i) personality, including vitality, poise and friendliness; (ii) photogenic appearance; and (iii) interaction with judges, including communication skills. Based on the scores calculated during the Live-Ratings, and the Global ratings as described in above point (b) the judges will select Top 10 finalist, by determining its cumulative figures (Global ratings + Live-Ratings).

      If a tie occurs during “Live Selection”, entries involved will be re-judged according to the criteria listed above by an additional judge who will serve as the tie breaker. Decisions of judges are final and binding in all respects.

   5. Global Online Voting (LIVE CONTEST).

      Contestants selected to as one of the Top 10 finalists must sign the “Titleholders/Representational” agreement in advance of “Live-Contest” Who will then undergo a professional photo-shoot for a week or 2 by representing one of the MCgo sponsor products and will quest for National Winner from Top 10 to Top 5, Top 5 to Top 2 and Winner exclusively through global online voting.

      If a tie occurs during Live-Contest, entries involved will be re-judged according to the criteria listed above by an additional judge who will serve as the tie breaker. Decisions of judges are final and binding in all respects.

4. MCgo REQUIRMENTS & CONTESTANTS AGREEMENT.

1. Contestants shall continue to be a person of good moral character;
2. Contestants should not indulge in and shall not commit any criminal or immoral activity;
3. Contestants should not, through any omission or commission, demeaned, defamed or denuded the Company, Contest, sponsors, advertisers, agents or affiliates of the Company;
4. Contestants should not defame or insult any fellow contestant or judges or organisers of the Contest before, during or after the Contest;
5. Contestants shall be punctual and maintain discipline throughout the Contest period.
6. Contestants understand and agree that incorrect information will result in disqualification, whether discovered prior to, during, or after the finals and a candidate shall be liable to the MCgo for such misrepresentations.
7. Contestants agree to participate in a disciplined and diligent manner throughout the contest program in accordance with the schedule of photo-shoots & events that will be given to them and participate without failure. .
8. Contestants agree to participate in all pageant related activities. Failure to participate will affect their pageant contest “Total Image” score and also termination from the Contest.
9. Contestants further agree that in the event she is announced The winner, 1st Runner-Up, or 2nd Runner- Up, she shall not compete/participate in any other beauty contest or pageant system for 12 months or until the title is relinquished to the new titleholder, unless authorized prior in writing by the MCgo, whose decision shall be final and shall not be subject to any review, or appeal.
10. The MCgo is not responsible or liable in any manner whatsoever for non-telecast of the show, or noncompeting/non-occurrence of the event.
11. Schedule of events and qualification rounds are subject to change at the absolute discretion of the organizers of the Miss Curvy National Beauty Pageant.
12. By participating, Contestants, their successors and representatives, hereby release and hold harmless the MCgo and its organizers and sponsors and its affiliates, principals, directors, officers, employees and agents from any and all liability for any damages (including direct, special, consequential, exemplary or indirect damages), loss or injury of any kind, or claims based on publicity rights, defamation, or invasion of privacy, arising from or in connection with the Miss Curvy National Beauty Pageant or any prize won, whether arising out of contract, warranty, negligence, strict liability in tort or otherwise.
13. All prizes are subject to deduction of tax at source and all other taxes, as required by law.
14. MCgo reserve the right, at their sole discretion, to reject, disqualify, modify, edit, revise, and remove any nude, obscene, defamatory, profane, offensive, lewd, or pornographic entries, subjects, entries, or videos and photos, or any entry or part thereof which MCgo, in their sole discretion, determine to be inconsistent with their contest standards, audience expectations, or reputational interests, or that MCgo believe may violate any applicable law or regulation or the rights of a third party. By entering this Contest, entrants consent to a background check and MCgo reserve the right, at their sole discretion, to disqualify any entrant whose participation may, for any reason or perceived reason, subject the Contest, MCgo, or MCgo advertisers, clients or customers to negative publicity, controversy, scorn, or ridicule.
15. MCgo assume no responsibility for entries they are unable to process due to network, hardware or other technical failures or any other reason, or incomplete, damaged, misdirected, illegible, stolen or lost mail, on-site or online entries. MCgo reserve the right, in their sole discretion, to disqualify any person tampering with the entry process, the operation of the web site or who is otherwise in violation of the Official Rules.
16. MCgo further reserve the right, in their sole discretion, to modify, terminate or suspend this Contest should any computer virus, bug, technical corruption, unauthorized human intervention or force majeure affect the administration, security or proper play of the Contest or MCgo otherwise become incapable of running the Contest as planned. In the event of cancellation, MCgo reserve the right to select Winners from among all eligible entries received prior to date of cancellation. The use of automated entry systems or any other conduct that impedes the integrity of the Contest is prohibited. In the event of a dispute regarding online entry, entry will be deemed made by the holder of an established e-mail account associated with the entry.
17. Failure to abide by the aforementioned representations shall result in immediate disqualification from the Contest, removal from the Contest premises, legal charges claim, and withdrawal of prize (if the offender is a winner of the Contest).
18. In case a winner is disqualified at any stage of the Contest for any reason whatsoever, the next best ranked contestant shall automatically replace such winner.
19. The MCgo reserves the right to charge any other amount from the Contestants at any stage before or during the Contest. In case of imposition of such charges, the participation of the contestant shall depend on the payment of such charge(s) as and when they become payable.
20. Contestants agree that these rules and regulations are subject to interpretation by the MCgo and shall be governed by the laws of the Zurich, Switzerland, that the court of the Zurich shall have the exclusive jurisdiction over any dispute or litigation arising from or relating to MCgo, and those Contestants agree to be subject to personal jurisdiction of the court of the Zurich, Switzerland.

5. PRIVACY.

By entering the Contest and providing the required entry information, each entrant acknowledges that the MCgo and its organizers, partners, sponsors and its affiliates may contact the entrant regarding this Contest and may also send the entrant information, samples or special offers about their goods or services that may be of interest to the Contest entrants. IF YOU DO NOT WISH TO SHARE YOUR INFORMATION, PLEASE DO NOT ENTER THIS PROMOTION.

6. DISPUTE RESOLUTION.

Except where prohibited, by participating Contest entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Sponsors and their agents, shall be governed by and construed exclusively in accordance with the laws of the Zurich, Switzerland. Entrant agrees that any action at law or in equity arising out of or relating to this Contest, or awarding of the prizes, shall be filed at Court of Zurich, Switzerland and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action.

Except where prohibited, by participating in this Contest entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Contest but in no event attorneys' fees; and (c) under no circumstances will any participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

7. DECLARATION.

By submitting the Entry Form and participating in the contest, all contestants hereby certify that they have read and I understand and agree to abide by these rules and regulations for the upcoming Miss Curvy National Beauty Pageant Contest and that they meet these requirements. All Contestants further agree to fully honor the rules and regulations of this Agreement and agree to indemnify MCgo and sponsors against all claims and causes of Acton that may occur as a result of MCgo fault. And hereby release and discharge MCgo and sponsors, its successors and persons, officers, authorized representatives, individuals connected with it from any responsibility, liability or claims, demands, costs, damages, expenses, loss of service, opportunity or any consequential event arising out of any act or occurrence during or leading up to or subsequent to the Miss Curvy National Beauty Pageant contest.
